How Does a Personal Injury Claim Work?

Overview of Personal Injury Law

Personal Injury Law is an area of California law that is designed to compensate an individual for the injuries they have suffered due to another person’s negligence. The legal foundation of personal injury law is established under Section 1714 of the California Civil Code, which provides, in pertinent part, as follows:

“Everyone is responsible […] for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person[.]”

In other words, we are all under a legal duty to exercise “ordinary care or skill” in going about our day-to-day affairs. If we don’t exercise ordinary skill or care, and our actions affect another person, then the law makes us responsible for our negligent actions. For example, a driver who is texting on the road and hits a bicyclist is clearly not exercising “ordinary care”. As a result, the driver is responsible for the injuries and damages sustained by the bicyclist. It’s only fair that he would be. That’s the essence of personal injury law – fairness.

Personal injury can occur in countless different forms: auto accidents, pedestrian accidents, slip and fall accidents, workplace accidents, medical malpractice, etc. In each case, the injured party may seek to recover damages from the negligent party (or their insurance carrier). For example, in the case of an auto accident, an injured party may seek monetary compensation from the at-fault driver’s insurance company by bringing forth a personal injury claim.

Also, it’s important to remember that there is a deadline for all personal injury claims. The deadline, also known as the “Statute of Limitations”, is the time period you have to file a lawsuit against the negligent party. California Civil Code Section 335.1 allows only two (2) years from the date of the incident to file your claim. After two years, your claim is barred and would be invalid.

How much is my injury case worth?
This is probably the most commonly asked question by our clients. The answer depends on a variety of factors, some of which include the following: (1) the extent of your injuries; (2) the extent of the property damage to your vehicle; (3) the medical bills you have incurred; (4) the loss of wages or income; (5) the length of time between the date of your injury and the date you first received medical treatment; and (6) the insurance policy limits. For instance, a brain or spinal injury that leaves the client paralyzed or results in cognitive impairment will likely result in a much larger settlement award than a client who has suffered temporary soft tissue injuries or superficial bruising.

How long does the personal injury claim process take?
The length of time it takes to obtain a monetary settlement from the other side’s insurance company depends on a number of factors. Often, the main factor involves the length of time needed for you to obtain adequate medical treatment for your injuries. When your medical treatment has concluded, your attorney can more easily evaluate the extent of your injuries, medical bills, lost wages or income, and other factors, in order to determine the appropriate amount that should be demanded from the insurance company. Therefore, immediate medical treatment is always advisable.

How much does a lawyer charge for a car accident?
